Many American companies sell their software products also in European markets and would like to benefit from the same patent protection that they have acquired in the USA. In practice, it often turns out that both the granting rates and the extent of protection are lower if these patents are filed in Europe.
Stefan Müller explains how to optimize patent protection in different countries. For example, the differences between the European Patent Office (EPO) and the United States Patent and Trademark Office (USPTO) with respect to the patenting of software are crucial in this respect. Patent attorneys with multi-jurisdictional experience are able to take into account the requirements of both jurisdictions in order to improve the granting rates and the extent of protection.
